It would be profitable to look at the patent rules of Tesla. Tesla's agreement states that it won't sue the other party for using patent rights only "for so long as such party is acting in good faith." Furthermore, the Pledge goes on to state that a party is acting in good faith as long as they have not:

"asserted, helped others assert or had a financial stake in any assertion of (i) any patent or another intellectual property right against Tesla or (ii) any patent right against a third party for its use of technologies relating to electric vehicles or related equipment; challenged, helped others challenge, or had a financial stake in any challenge to any Tesla patent; or marketed or sold any knock-off product (e.g., a product created by imitating or copying the design or appearance of a Tesla product or which suggests an association with or endorsement by Tesla) or provided any material assistance to another party doing so."

The aforementioned are some of the key legal informations. When we talk about the connection between India and Tesla's patent rights, it can be said that it is helping the electric vehicle startup to boom.

In an interaction with IIT Madras students, Tesla's co-founder, Elon Musk said that Tesla may hit the bumpy Indian roads by 2020. It is probably very good news for the Indian Tesla fans. It was also known that Elon Musk has been trying to enter the Indian market since a very long time. But due to some constraints, he couldn't. But, most probably, he assured in an talk with IIT Madras students in 2019 that Telsa will hit Indian roads very soon. The government is also with the electric vehicles because the Indian government is also trying to bring forth electric vehicles on Indian roads by 2030 and replace the gasoline vehicles with electric vehicles which is why the government has reduced the custom's duty on electric vehicles components and parts up to 5%.

Tesla always wanted to launch itself in India. But it has all been delayed because of various reasons like lack of infrastructure, policies for the electric vehicles and market for the electric vehicles. But this is not the case now. The Narendra Modi government has shown some kind of interest on Tesla. Hence, Nitin Gadkari, the Transport Minister of India has offered the company a piece of land near the port to import and launch its technology in India. This is nothing but a welcome step for Tesla.

In an attempt to promote electric vehicles in India, the government has reduced many custom's duty on the EV components. It varies from 5% to 15%. The Central Board of Indirect Taxes (CBIT) has made some exemptions for the components of EV; like the exemption of custom's duty on EV batteries, boost its production in India and subsequently set up its base in India such that it would help the Indian market and also the Make in India initiative in the times to come.

But, it must be said that Tesla's launch of EV in India seems to be delayed for some more time as there are no special infrastructural units in India of Tesla. It must be such that the unit which will be set up by Tesla must be competent enough to the quality of Tesla's technology. The timeline looks quite blur and nothing much could be said about this. On top of that, there is a lack of technology in the Indian market; there is also a lack of infrastructure and proper resources to accommodate the EV on the Indian roads.

There are various private and government establishments that are trying extensively to set up some infrastructural units of EVs in India. On top of that, the Indian government is also giving some subsidy and relaxation, and exemption of custom's duty on the EV components and so on and so forth to encourage and produce electric vehicles and its components in India. It is the time that will say whether Tesla could launch or not by 2020.

The market in India is actually big enough for Tesla. But the problem is the infrastructure in India. The company decides to import all the components and assemble them all in India. But the problem here is the taxation amount. Although the price will be more, but according to Indian Tesla fans it can be said that they are willing to buy Tesla EVs even it is sold at an exorbitant price. Tesla is totally trying to set its manufacturing unit in India. Moreover, the company will have to invest in other things like the batteries of the car and the production of the parts.
